In the state of California, eviction laws require that landlords provide tenants with notice before they file the Unlawful Detainer with the courts. An Unlawful Detainer is a legal process that eventually terminates the tenant's right to occupy the rental property and would allow authorities to forcibly remove a tenant if they do not leave.
The law directs that certain circumstances require that specific procedures be followed. A landlord may need to serve their tenant with a 30-day, 60-day, or 90-day notice. In cases where a tenant has not paid rent, has allowed activities at the property that are in violation of the law, has caused a disturbance to the other renters, or has violated the lease agreement in some other way, a landlord can choose to give only a 15-day notice. After the appropriate notice has been given, landlords can then file for the legal action of an Unlawful Detainer.
