California eviction law states that a landlord seeking to evict a tenant must notify the tenant of the situation before filing an unlawful detainer. The process known as an unlawful detainer will eventually end the tenant’s right to continue residence in the rental property. This then allows the authorities to remove the tenant, by force if necessary, if they do not vacate the premises on their own.
According to the law, there are specific procedures required for different circumstances. Landlords may need to provide the tenant with a 90-day, 60-day, or 30-day notice of their intent to evict. If the tenant has failed to pay their rent, caused a disturbance to neighbors, allowed illegal activities to occur at the property, or failed to fulfill the lease in another way, the landlord can choose a shorter notice of only 15 days if they wish. Once the relevant notice has been provided to the tenant, property owners can then file the unlawful detainer.
